Privacy Notice

This privacy notice describes how we collect personal information from you during our interactions with you, and how we use that information. This includes information we collect when you use our website or other online services, such as our crowdfunding platform Boosted.

1. Terms used in this notice

In this notice:

  • references to ‘Arts Foundation’, ‘we’, ‘us’ or ‘our’ are references to the Arts Foundation of New Zealand, a charity registered in New Zealand (registration number CC24256)
  • when we say ‘New Zealand privacy law’, we’re referring to the law that covers the collection, use, storage, and disclosure of personal information in force at the time that you interact with us, including the Privacy Act 2020.

2. Information we collect – and why

We may collect the following information from you when you interact with us:
 

2.1. Information we require to enable us to provide our services, including: 

  • your name
  • contact details including your email address, postal address and phone number
  • your gender, date of birth, age, and other demographic details
  • password
  • your preferences and interests
  • any relevant details relating to your place of residence where our services may be provided
     

We collect this information for all purposes relating to the provision of information or our services to you, including to: 

  • communicate with you and respond to communications from you
  • provide you with services and information on services
  • contact users who have registered a project
  • promote in relation to a user’s Boosted activity, donations or running a project
  • personalise the services and information that we provide to you (including when we host events)
  • facilitate our general internal processes (such as record keeping, database management, resetting passwords)
  • facilitate our own internal business purposes, such as marketing analysis and community feedback
  • facilitate our legal obligations

 

2.2. Usage data collected through the use of cookies, such as:

  • entry point
  • device used
  • browser used
  • location (country) visited from
  • time spent on site
  • engagement with site


We collect this information so we can provide our services to you and improve our service offering by better understanding how users interact with our website.
 

2.3. Information associated with the creation of a project, including:

  • name
  • synopsis
  • region
  • genre 
  • collaborator name
  • collaborator email address
  • anything included on the project page (e.g. project details, image, video link)


We collect this information for all purposes relating to the promotion of a project, including:

  • to undertake promotional activities
  • for our internal reporting processes
     
     

2.4. Information association with donation to a project:

  • name
  • email address 
  • contact number
  • country
  • message of support
  • a photo of you


We collect this information to identify you as a donor, with your permission, either on our website or by notifying the project participants (including by specifying any amount or amounts you have donated).

We collect this information for our internal reporting processes.


2.5. All personal information we collect about you, including the above.

We collect this information for the purposes set out in paragraph 7 (Other use of your information).

3. If you do not agree to provide us with your personal information 

You don’t have to give us your personal information. But if you do not provide us with information, we may not be able to provide you with information or our services.

4. Information others give us

We might receive your personal information from third-parties, who you have authorised to disclose your personal information to us.
The collection and disclosure of that personal information by those third parties will be governed by the terms you’ve agreed with them.

5. Information you give us about other people

We may collect information about someone else from you.
If you do provide us with someone’s personal information, you must make sure you have that person’s authority to do so and you must make sure that person knows that their information may be used by us in the circumstances set out in this notice.

6. Stripe

Where you make a payment using our website, you will be directed to Stripe. Stripe collects payment information directly from you and holds that information in accordance with Stripe’s own privacy notice.

7. Other use of your information

We only use your information in the way described in this notice, or if we’re permitted or required to do so under New Zealand privacy law.
In addition to the specific ways that we use your personal information outlined above in paragraph 2 above, we may also use your personal information:
 

  • to enable and support you in accessing and using our services
  • to improve user experience on our website 
  • to provide you with important notices and information about the numerous services we offer, including newsletters and promotional materials to subscribers
  • for internal business purposes, such as marketing analysis and community feedback
  • for any other purposes for which you have given permission.


We might also combine data or information that we have collected about you, with the information we collect from others, for the purposes described in this privacy notice.

8. Where your personal information is held

Our service providers may store your information on our behalf (for instance, the service providers described in paragraph 9 (Sharing your information)).
We may also hold your personal information ourselves – for instance, on servers or in physical files located on our premises.

9. Sharing your information 

We only share your information for the purposes described in this notice, or as otherwise permitted under New Zealand privacy law. 
In addition to the specific ways that we’ve described throughout this notice, we may also share the personal information we hold about you with the following persons:
 

  • any business that supports our services, including any person that hosts an IT system that we use to provide our services
  • Meta and Google Ads, with whom we may share cookies and unique data for retargeting 
  • email marketing platforms such as Mailchimp and CRM systems such as Monday.com
  • project owners to whom you have donated, as authorised by you
  • the Arts Foundation Te Tumu Toi Board 
  • any other person we are authorised or required to share information with under New Zealand privacy law
  • any other person authorised by you. 

10. Your rights

You have the right to:

  • request access to personal information that we hold about you and
  • request that we correct personal information that we hold about you.
